i'm trying to decide if it's better or worse than this guys defence of having sex with a girl and apparently not realising that she was already dead.

well, i think it's pretty safe to say that he murdered her. the idea that he found her lying motionless on the ground, with seven stab wounds, had sex with her and didn't realise she was dead until afterwards seems just a tiny bit far-fetched. i find it bizarre that he thought his best chance of getting off of the charge of murder was admitting rape and accidental necrophilia.
