Don't let some of the bad editing in this story keep you from reading it.  The further I got into it, the more I became convinced the MS inside source interviewed here is competent, and legit.  It's a most informative read for anyone interested in the X360.

It figures that the heat problems come from the ATi chip, not the CPU.  We got enough unhappy Radeon users right here.  But it's not that simple, and not all ATi's fault (not even close).   Must read.

Wow.  Hell of a read.  Makes me really wonder why all of us aren't trying to get a class action lawsuit happening here.  I'd like to have a 360 that's going to last me a while since there are games on the system I'll surely want to play again someday, but I can't afford to buy another when this one fucks up after warranty.  These people should be held accountable, and who gives a fuck if they lose another 6 billion?  Frankly, I think they've been pulling similar stunts in software development for too long.  Damn it, why doesn't somebody smart get the ball rolling on this?

Thanks for posting that. I am skeptical about these things normally, but the reasoning from the "source" makes me think this is legit.

I suppose it's possible for the whole thing to be made up.  If it is, they did a hell of a job.  [Edit:  I.e., what Que said while I was typing.]

Passing along known design flaws assuming they can be handled later could be the basis for a lawsuit.  I think the problem is that, unlike the Ford Pinto blowing up because of similar reasoning, no one is going to die because of a 360's melting innards.  They won't suffer anything beyond inconvenience, as long as the warranty is in place.  Still, you multiply any number by a few million plaintiffs, and some sharks should bite.  Evidence is needed first, and I wonder if this guy can be persuaded to testify (assuming he really is the "Deep Throat" of Microsoft).

The problem with class action lawsuits is that they rarely result in much compensation for the plaintiffs / class members. The lawyers end up the best off.
