UbiSoft buys the "Tom Clancy" name to buy rights to anything Tom Clancy-related -- books, life, games, movies, merchandise, etc etc.

It'll possibly cost UbiSoft around 20 million euros and some other extra payments over the next 2 years.

Ubisoft announces they have purchased the name Tom Clancy from Tom Clancy for the royalty-free creation of future games (so presumably the author won't have to get new checks printed for his personal life). Interestingly, besides video games, this also covers "ancillary products including related books, movies and merchandising products," so we will possibly see movies as a result of this deal, not to mention more Tom Clancy books not authored by Tom Clancy. The announcement is intentionally obtuse about financial arrangements, but on the surface it looks like this entails an up-front payment of around 20 million Euros, with additional payments to follow over the next two years:

    SAN FRANCISCO – March 20, 2008 – Today, Ubisoft, one of the world's largest video game publishers, announces that it has concluded an agreement with Mr. Tom Clancy to acquire all intellectual property rights to the Tom Clancy name, on a perpetual basis and free of all related future royalty payments, for use in video games and ancillary products including related books, movies and merchandising products.

    The price of this all cash acquisition is not currently disclosed. Post acquisition, Ubisoft expects to have a net cash position of around 130 million Euros by the end of fiscal 2007-08, compared to a previous expectation of approximately 150 million Euros. Additional payments will be made as well in fiscal 2008-09 and fiscal 2009-10.

    On the basis of past performance of Tom Clancy branded video games, and excluding any potential contribution coming from sales of ancillary products, the royalty savings generated by this acquisition are estimated to have an average positive impact on Ubisoft's operating income of a minimum of 5 million Euros per year.

    "After ten years of a highly successful collaboration which has seen the creation of blockbusters that set standards in the videogame industry, such as Tom Clancy's Splinter Cell, Tom Clancy's Ghost Recon, and Tom Clancy's Rainbow Six, today, acquiring the perpetual property rights of the Tom Clancy name for video games and related projects is a major event,” stated Yves Guillemot, Chief Executive Officer at Ubisoft. "The future of our industry lies in our capacity to create and develop brands that captivate consumers and that present a myriad of opportunities for the full spectrum of entertainment, be it video games, books, movies or other media. The Tom Clancy brand is recognized around the world for offering exciting video games, films and books. The most recent example of such value creation through brand management is the EndWar book, based on the video game story, which has been in the NY Times top 10 Paperback Mass Market Fiction bestseller list for the last four weeks. Capitalizing on the strong franchises that we've built over the past 10 years, we will take the Tom Clancy game brand to the next level of the global entertainment industry."

So does he now have to license his name from Ubisoft if he wants to write another book?  I mean this is unbelievable.

Apparently it was upwards of 20 million. He also can write Tom Clancy books, but with a slight compromise. His next book will be called "Ubisoft's Tom Clancy's Without Remorse."

Tom Clancy is definitely a household name everybody recognizes --  from games to books to movies; to any sort of media.

But, it is really crazy that Ubi owns his actual name now!

If I had a franchise of products under one name, I wouldn't use just my real name like say Tom Clancy did.

I'd at least find some sort of fictitious title to cover all of my IP's, if Ubi or someone wanted to buy all my IP's for a ridiculous sum of money.

Don't get me wrong, I think it's an incredibly stupid concept to sell your name like this.  I do believe, however, that Clancy himself 'retired' (don't big authors retire and come back all the time?) a few years ago.  This is probably just a (stupid) way to add a little bit more to the retirement fund.   I would like to know the specifics though; like if he actually sold his name completely or just cut a deal giving them unlimited licensing rights for a set period of time instead of them having to pay him case by case fees and royalties for everything they throw his name on to.

What's kind of interesting here is the books aspect.  Not so much because he's an author but more because from what I can tell he started licensing his name out for novels he had little or nothing to do with years ago.  This is made evident when you're in a bookstore and see "Tom Clancy's Splinter Cell: Retarded Subtitle"  by Joe Blow and a couple other series of books that I don't think he ever wrote a word of (Nethack? Netforce?).  I wonder if it was a similar licensing agreement and now those publishers have to sub the rights off of Ubisoft rather than Clancy himself.

Netforce. Yes those are more like pop culture books and aren't very good.
