The ad is misleading for sure.  However, I wouldn't want the Wii version of my game being the one that everyone sees either. On the other hand, if I were going to show the 360 version I certainly wouldn't have used Wii controls in the commercial, even though that's a huge selling point.

All in all pretty underhanded, but I can definitely see EA's point.  Wii graphics look terrible compared to everything else.

If you show a Wii controller and 360 graphics, you are lying.  One or the other is OK, but not both together as if they come together.  False advertising is illegal, as well as lying.

Oh I'm not absolving them.  They fully knew what they were doing.  They did it and got caught.  Companies do stuff like this all the time.  It's ridiculous, but I guarantee the reward greatly outweighed the risk.

That's up to the people who caught them and get to decide how much to impose in fines.  My suggestion would be all profits from the game so far.  Wrist slapping is not deterrence.

A jewel thief understands when the reward can outweigh the risk, that doesn't make his profession of choice any more legal.

My disposition on EA's DRM policies aside, EA are being flat-out deceiptful and must be reprimanded and punished seriously.

Personally I think Riccitello and various other execs should receive minor cuts in the thighs and then tossed into shark-infested waters, whoever survives gets to live. But since that's not likely to happen, I think EA should issue a formal apology and explanation to the public as well as surrender any revenue from the release date till the date of the apology.

Meh. It's not much different than photoshopping a girl to make her look pretty in a magazine, or a movie promo just showing all the funny clips during the trailer.

Actually, I'd say it's quite different.  In the case of a movie promo, you're seeing what the actual movie looks like, even if you're just seeing clips of it.  It's not lying about the visuals.  And photoshopping a girl for a magazine... well, you're never going to get the girl, hence you're never going to know the truth of it one way or the other.

I was just pointing to the overall trend of deception in advertising. Anyone who thinks that they are getting what is sold to them is plain stupid.

As for EA... what, we don't expect this kind of behavior?  I know their image has improved in some circles lately (GWJ crew), but I cannot for the life of me figure out why.

Plus they are even investing new IP, though that isn't working out well enough -- and that sucks.

As my direct reaction to EA faking their games (Dead Space) being banned in some places...
I'm trying to say I wish EA faked their games had DRM -- meaning I wish their games had no DRM and that they lied that their games actually have DRM.

Exactly. I'm glad to see EA trying some new stuff -- but sheesh, I wish more gamers caught on -- at least on the console side, since they don't have to deal w/ DRM and since they seem to the ones the publishers really look towards for sales.

And yes, I hope they figure out the DRM thing, too.

What they did w/ a Spore De-Authorization Tool (Revoke Tool) is a very tiny start in the right direction...
